Terms of service
These terms form the agreement between you and Shwastik Mail for the use of Shwastik Mail.

1. Agreement
By creating an account, accepting an invitation or using Shwastik Mail (the “Service”), you agree to these Terms of Service, our Privacy policy, our Acceptable use policy and our Cancellation and refund policy. “We”, “us” and “our” mean Shwastik Mail. “You” means the person using the Service and, where you act for a business, that business.
If you do not agree to these terms, do not use the Service.
2. The service
Shwastik Mail provides hosted business email on domains that you own, including mailboxes, aliases, groups, webmail, access through standard mail protocols (IMAP, POP3, SMTP and related protocols) and an administration console. Features and limits depend on the plan your organization subscribes to, as described on our pricing page.
3. Accounts and organizations
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- You must give accurate sign-up information and keep your email address up to date.
- An organization holds domains, mailboxes and members. Its owners are responsible for everyone they invite and for all activity in the organization, including by mailbox users.
- You are responsible for keeping passwords, recovery codes and devices secure. Tell us promptly at security@shwastik.com if you suspect unauthorised access.
4. Your responsibilities
- You may only add domains that you own or are authorised to manage.
- You are responsible for publishing and maintaining the DNS records we provide. Mail delivery depends on them.
- You are responsible for the content of the messages you and your users send and store, and for having any consent required to process the personal data they contain.
- You must follow our Acceptable use policy and all applicable laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
5. Trials, fees and payment
- New organizations receive a free trial of 14 days. You can subscribe to a paid plan at any time.
- Paid plans are billed monthly in advance in Indian rupees through our payment partner, Razorpay, and renew automatically until cancelled. Applicable taxes are added where required by law.
- If a payment fails or a trial ends without a subscription, you have a 7-day grace period before the organization is suspended.
- We may change prices with at least 30 days’ notice by email. Changes apply from your next billing period.
- Cancellations and refunds are governed by our Cancellation and refund policy.
6. Suspension and termination
You can cancel your subscription at any time, and an owner can delete the organization from the console after removing its domains. We may suspend or terminate an organization, a mailbox or an account, with notice where practical, if:
- payment is overdue after the grace period;
- you breach these terms or the Acceptable use policy;
- we must do so to comply with law or a lawful order; or
- continued use poses a security risk to the Service, other customers or the internet at large.
While an organization is suspended, sign-ins to its mailboxes are blocked but incoming mail continues to be delivered for as long as the organization exists. Service is restored when the reason for suspension is resolved.
7. Your data
You keep all rights to your data, including messages, contacts and calendars. We process it only to provide the Service, as described in our Privacy policy. You can export mail at any time using IMAP.
We back up the Service daily and keep backups for 14 days to recover from failures. Backups are not a substitute for your own records; deleted mailboxes and domains cannot be restored on request.
8. Availability and support
We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. Maintenance, failures of third-party networks, and the delivery policies of other mail providers are outside our full control. Support is provided by email during Monday to Saturday, 10:00–18:00 IST.
9. Intellectual property
The Service, including its software, design and brand, belongs to us or our licensors. Open-source components are provided under their own licences, listed on our open-source licences page. You may not copy, resell or reverse engineer the Service except as those licences or the law allow.
10. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose. Spam filtering cannot catch every unwanted message and may occasionally mark legitimate mail as spam.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the fees your organization paid us in the three months before the event giving rise to the claim.
12. Indemnity
You agree to indemnify us against claims, losses and costs arising from your content, your use of the Service in breach of these terms, or your violation of any law or third-party right.
13. Changes to these terms
We may update these terms from time to time. We will post the new version on this page and, for material changes, notify organization owners by email at least 30 days before they take effect. Continuing to use the Service after that means you accept the updated terms.
14. Governing law
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of India.
